大陆架大陆架continentalshelf从海岸起在海水下向外延伸的一个地势平缓的海底地区的海床及底土，在大陆架范围内海水深度一般不超出200米，海床的坡度很小，一般不超过1/10度。国际法认为，大陆架是邻接一国海岸但在领海以外的一定区域的海床和底土。沿海国有权为勘探和开发自然资源的目的对其大陆架行使主权权利。大陆架是一国领土在海水下的自然延伸，这是沿海国对大陆架享有某些主权权利的理论根据。大陆架总面积2710万平方千米，占全球面积5.3％，约占海洋总面积7.5％。几乎所有大陆岸外均有大陆架发育。大陆架地形比较平坦，但也可有起伏20米左右的丘陵、盆地和谷地等。大陆架蕴藏着石油、天然气和其他矿物资源。世界上石油产量20％来自大陆架。大陆架上的水域也是海洋生物资源最丰富的地方。世界上渔获量90％来自大陆架上面的水域。许多国家主张对大陆架行使主权权利，法律上的大陆架概念在不断变化。首先对大陆架提出管辖权主张的是美国，随后不少国家发表了类似的关于大陆架的声明。1958年联合国第一次海洋法会议通过的《大陆架公约》规定，大陆架是“邻接海岸但在领海范围以外，深度达200米，或深度超过此限度而上覆水域的深度容许开采其自然资源的海底区域的海床和底土”。据此，200米海水深度是国际法上确定大陆架的一个标准，技术上能够开发也是一个标准。所以大陆架的范围可随技术的发展而扩大。1982年通过的《联合国海洋法公约》规定：“沿海国大陆架包括其领海以外依其陆地领土的全部自然延伸，扩展到大陆边外缘的海底区域的海床和底土，如果从测算领海宽度的基线量起到大陆边的外缘的距离不到200海里，则扩展到200海里的距离。”关于沿海国对大陆架的权利，《公约》规定：“沿海国为勘探大陆架和开发其自然资源的目的，对大陆架行使主权权利”。这种权利是专属的，即沿海国不勘探大陆架或开发其自然资源，任何人未经该国明示同意，均不得从事这种活动。但沿海国开发从测算领海宽度的基线量起200海里以外的大陆架非生物资源，须向国际海底管理局缴纳一定的费用。大陆架的自然资源包括海床和海底的矿物和其他非生物资源，以及属于定居种的生物，即在可捕获阶段在海床上或海床下不能移动或其躯体须与海床或海底土保持接触才能移动的生物。
